Clearwater Tour Company Liability Waiver

By participating in Clearwater Tour Company tours, you acknowledge and agree to the following:

1. **Assumption of Risk: ** I understand that participation in water-based activities such as snorkeling, swimming, kayaking, and other excursions involves inherent risks, including but not limited to injury, drowning, accidents, equipment failure, and unpredictable weather or water conditions. I voluntarily assume all risks associated with these activities.

2. **Waiver of Liability: ** I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Clearwater Tour Company, its employees, agents, and affiliates, from any and all liability for injury, illness, death, or property damage that may occur during the tour. This waiver applies to all activities associated with the tour, including transportation to and from the excursion sites.

3. **Medical Fitness: ** I certify that I am physically fit and have no medical conditions that would prevent me from safely participating in the water-based activities offered by Clearwater Tour Company. I agree to inform the staff of any medical conditions or concerns prior to participation.

4. **Dietary and Food-Related Waiver: ** Clearwater Tour Company uses the highest standards in food preparation and service to ensure the safety and quality of meals and beverages provided on board. However, I acknowledge that despite these precautions, certain issues may arise, including food allergies, sensitivities, cross-contamination, or unknown ingredients that could lead to adverse reactions or emergencies. I agree to disclose any known dietary restrictions, allergies, or sensitivities to Clearwater Tour Company staff prior to the tour. I understand and accept that it is ultimately my responsibility to manage my dietary needs. Clearwater Tour Company cannot be held liable for any health issues, allergic reactions, or medical emergencies resulting from the consumption of food and beverages provided on the tour.

5. **Alcohol Consumption: ** If I choose to consume alcoholic beverages during the tour, I do so at my own risk. I understand that Clearwater Tour Company is not responsible for any incidents, injuries, or accidents that may result from alcohol consumption, including impaired judgment or behavior.

6. **Compliance with Instructions: ** I agree to follow all instructions given by the tour guides and staff for my safety and the safety of others. Failure to comply with safety guidelines may result in removal from the tour without a refund.
